So what? She was an attorney and that was her job. Besides, everyone knows tests, especially back then, were discriminatory against minorities. That is why they were written. Most tests purpose are to keep people out, not in! I can't believe that people are acting like it is a big secret!

Please read late BU professor Dr William Ryan's book "Blaming the Victim". You would get some great insight into how it is practiced.

So the Republicans get upset with a minority. They have always disliked them anyway unless they were being used as slave labor!,

I love how when a minority group fails to score as well on a test as some other group, they cry racism and Biased Tests.
Every instance I've ever seen of it has turned out to be tests with those biased racist questions like "4+6 = ? " and "how many sides does a square have?"

If those are racially biased questions, reality itself needs to be taken apart and redesigned.

Lame story and will do nothing to help the Repubs stop her nomination. Sessions is more racist then Sotomayor.. Conservs. have always hated affirmative action... I'd be more worried about her views on the 2nd amendment.

Discrimination has been endorsed by the federal courts, and the politicians as long as they get paid. The cost of this is liberty and freedom. Discrimination of anyone is morally wrong. The government does it every day with quotas and age. The government that is big enough to "take care" of you can and will take away, limit, control, and tell you what is good for you. You pay them, you wait in line for any service they control. SOCIALISM IS SLAVERY. THE COST IS LIBERTY AND FREEDOM.

When tests are needed to get ahead in a job, would believe most people would study for the test, If you do not speak english you maybe in alot of trouble. When will workers understand that if one wants to get ahead you have to study and work harder than the next person. One does not get handed a pass just because you can not pass a test or even work hard to do so. They can sue all they want but it does not change the facts. Sotomayor was not handed a degree cause she did not work hard for it, so what makes her believe that a worker does not have to do the same, You get ahead by doing, not by suing different groups.

It is still amazing to me that if you do not agree with someone who is non-white, you are a racist. I am a Hispanic American and if my boss doesn't agree with me then I should label him a racist. You people are IDIOTS!

If you are not as smart as someone who is white, why should you get into college, or get a job because of your race. Surely that's not why you would want to be hired. Go to school, work hard to get your education and then go and get your job fair and square. That is what I try to instill in the students I teach every day, because Lord knows their parents surely don't do that!

I know someone will feed me the line that the people hiring don't make it fair and square and would rather hire the less educated white person than a more educated non-white person. Give me a break, there's more than one place to work!

Tests are fair as long as you take the time to study for them. If you do not study you risk the chance of failure. If it has to do with job performance issue and you know your job the test should be no problem. If a test is failed in school did you pass on to the next level or grade I think not. She is not even qualified to replace Judge Judy in my opinion. Maybe she needs to retake all the test she supposedly passed and probably due to a grading curve due to the fact she was a minority. I remember taking a test for the Post Office back in the 70's. I scored a 94 % but anyone black, hispanic or a woman couls score lower than me but were given points because and had the opportunity to be hired. The only one I felt was fair at the time to be given points were the Veterans. It has been going on for a long time. She continues to cry the blues. This is America where english is the language spoken. If you have the ability to speak more than one language that is great.
